I have done a sale agreement of shop with buyer. As per agreement, he gave some advance payment and remaining to be given in 3 months . Condition was that I he is unable to pay or back off , I will confiscate the advance amount and if I am backing off , double of the advance to be returned. Now he is unable to pay and backing off

Is it halal to keep his advance payment as per agreement?

The answer to your question is as follows:

The condition mentioned in the question is not valid. So, if the customer withdraws from buying the shop or is unable to pay the remaining amount and he is not able to buy the shop, then it is obligatory upon you to return the total advance amount to the customer. It is not halal for you to keep the advance amount given by him. Moreover, if you cancel the deal and return the total amount (received as an advance) to him, Allah would reward you for the sympathy you showed to him, In-sha-Allah.  

قال الموفق فی"المغنی" العربون فی البیع ھو ان یشتری السلعۃ ۔۔۔ فیدفع الی البائع درھما او غیرہ علی انہ اخذ السلعۃ احتسب بہ من الثمن والم یاخذھا فذالک للبائع.... وقال ابو الخطاب (من الحنابلۃ ) : انہ لایصح، وھو قول الشافعی و اصحاب الرای". (إعلاء السنن: (6026/12)

العربون والعربان : بیع فسرہ ابن منظور بقولہ:" ھو ان یشتری السلعۃ ویدفع الی صاحبھا شیئا یلی انہ ان امضی البیع جائز حسب من الثمن، وان یمض البیع، کان لصاحب السلعۃ، ولم یرتجعہ المشتری۔
واختلف الفقہاء فی جواز العربون: فقال الحنفیۃ والمالکیۃ واشافعیۃ وابو الخطاب من الحنابلۃ : انہ غیر جائز". (فقه البیوع: (113/1) عَنْ أَنَسِ بْنِ مَالِكٍ , أَنَّ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ:  «لَا يَحِلُّ مَالُ امْرِئٍ مُسْلِمٍ إِلَّا بِطِيبِ نَفْسِهِ» (سنن الدارقطنی 3/424 الرقم 2885) من أقال مسلما بیعتہ أقال اللہ عثرتہ (رواہ ابوداوٴد)
