My husband gave me first Talaq 2 weeks ago after which we have separated from each other but living in the sane house. He announced it in front of my 3 children out of whom two are adults and one is a minor. He has repeatedly agreed that he has given me first Talaq but is not approaching the arbitrary council to legalise it.
My Questiion is: what happens if in 90 days we fail to compromise and resume our relationship as husband and wife in the light of shariah?

In the name of Allah the most Gracious the most Merciful

The answer to your question is as follows:

It is the responsibility of both husband and wife to make married life happy and must ignore petty altercation. However, in the case mentioned above, the husband has given a revocable divorce. So, if the husband takes his wife back into his marriage before the expiry of the period (three menstrual periods), the marriage will remain intact and there is no need to do anything else.

The Iddat of a menstruating woman is three menstrual periods; there are no fixed days, so if 90 days have passed but the menstruation has not yet completed, Raj’at (revocation) can be performed and the husband should establish a relationship with his wife or verbally say that I took my wife back in my nikah. However, if three periods have completely passed, both the spouses can live together only by remarrying and with a fresh dowry. The husband will be entitled of two divorces only in the future.

And Allah knows best
