I live in Bangladesh. My father suffers from Liver Cirrhosis. I have plans to do Masters or PhD from USA. It is recommended for my father to do liver transplant. But Currently I liver transplant is not available in Bangladesh. And in India it will cost 1-1.5 crore Bangladeshi (currency), which is unaffordable. When I start PhD in US will it me permissible for me to buy an insurance for my father, take him to US and do the liver transplant and then send him back to Bangladesh? Currently I couldn’t find any Takaful Health Insurance in US. And don't know how the rest of the insurance work there might be be riba and qimar. So will it be permissible in case like this? Can I buy insurance for him and take him to US? Cuz without the treatment he might suffer a lot and die within short span.

The answer to your question is as follows:

In normal circumstances, availing insurance policy is Haram as it involves interest and gambling. However, in case of a severe health problem, if you have no other choice than the one mentioned above, while the financial situation is not good, the cost of liver transplant is too high and the life of the father is also in danger, then availing insurance facility in such a critical condition is allowable.

الربا ھو الفضل المستحق لأحد المتعاقدین فی المعاوضة الخالی عن عوض شرط فیہ (ھدایہ آخرین 2/82)

 ﴿وَلَا تَأْکُلُوْا أَمْوَالَکُمْ بَیْنَکُمْ بِالْبَاطِلِ﴾ أي بالحرام، یعني بالربا، والقمار، والغصب والسرقة (معالم التنزیل 2/50) لأن القمار من القمر الذي یزداد تارةً وینقص أخریٰ۔ وسمی القمار قمارًا؛ لأن کل واحد من المقامرین ممن یجوز أن یذہب مالہ إلی صاحبہ، ویجوز أن یستفید مال صاحبہ، وہو حرام بالنص (شامی، کتاب الحظر والإباحة، باب الاستبراء، فصل في البیع 9/577 ط:زکریا دیوبند)۔

(الْمَادَّةُ 18) : الْأَمْرُ إذَا ضَاقَ اتَّسَعَ. يعني أَنَّهُ ظهرت َمَشَقَّةٌ فِي أَمْرٍ يُرَخص فيه ويوسع (الْمَادَّةُ 19) : لَا ضَرَرَ وَلَا ضِرَارَ. (الْمَادَّةُ 20) : الضَّرَرُ يُزَالُ. (الْمَادَّةُ 21) : الضَّرُورَاتُ تُبِيحُ الْمَحْظُورَاتِ. (الْمَادَّةُ 22) : مَا أُبِيحَ لِلضَّرُورَةِ يَتَقَدَّرُ بِقَدْرِهَا. (الضرورات تقدر بقدرها) (مجلۃ الاحکام العدلیۃ، المقالۃ الثانیۃ فی القواعد الکلیۃ 1/18)
